Suspect in fatal Green Lake County UTV crash charged

GREEN LAKE (WLUK) -- Megan Zimmerman had a blood alcohol level of .240 -- three times the legal limit -- when she allegedly crashed a UTV, killing two of her passengers, according to a criminal complaint. She told police she didn't remember being the driver. Zimmerman, 26, was charged with two counts of homicide by intoxicated use of motor vehicle and one count of recklessly endangering safety for the April 18 crash. Nicole Deaver, 40 and Timothy Kamphuis, 46, were killed. Bond was set at $5,000 cash at a previous court hearing . During Zimmerman's initial appearance Tuesday, Judge Mark Slate removed himself from the case due to the possible appearance of a conflict of interest. The judge said he knows the sister of one of the victims, and, at one point, lived with her husband, though he never met the victim herself. The preliminary hearing won't be scheduled until a new judge is assigned. The defendant and others told police they were drinking alcohol much of the day. "Law enforcement found empty alcoholic beverage cans, two bottles of whiskey both partially empty and soda mixers in and around the UTV at the crash scene," the complaint states. A witness told police the UTV was travelling at 40 mph or more, and lost control entering a curve. "(The witness) saw the UTV slam in to a tree head-on, go vertical and slam down on its passenger side," the complaint states. An analysis of cell phones for those in the UTV show it was going about 60 mph shortly before the curve, and then 46 mph entering the curve. The speed limit was 35mph. Zimmerman couldn't recall if she was driving. "When asked if she was ever in the front seat Defendant stated "I don't believe so." When asked if she ever drove/was in the front passenger seat she stated she didn't believe so," the complaint states. Video from a place the group had stopped placed Zimmerman in the driver's seat, as did witnesses.
