Ex-NYPD Officer Indicted In Fatal DWI Crash That Killed Motorcyclist On I-87 In Cornwall

A former NYPD officer from Westchester County has now been indicted on manslaughter charges in connection with a fatal drunk driving crash on the New York State Thruway that killed a motorcyclist in Orange County.  Kevin Richmond, 44, of Elmsford, was arraigned on Wednesday, April 1, in Orange County Court on charges of second-degree vehicular manslaughter and two counts of driving while intoxicated, according to New York Attorney General Letitia James.  The indictment stems from a crash that happened just after midnight on July 27, 2023, in the Town of Cornwall.  As previously reported by Daily Voice, prosecutors allege Richmond, who was off duty at the time, was driving his personal vehicle while intoxicated when he collided with a motorcycle operated by Nidia Nieves, who was traveling northbound on I-87.  Nieves was thrown from the motorcycle and suffered traumatic injuries. She was pronounced dead at the scene. Prosecutors allege Richmond was intoxicated and/or had a blood alcohol content of at least 0.08 percent at the time of the crash.  Richmond had previously been arrested and arraigned in June 2025 on the same charges. The newly unsealed indictment advances the case in Orange County Court.  At Wednesday’s arraignment before Judge Craig Brown, Richmond’s bail was continued at $40,000 bond or $20,000 cash. He is scheduled to return to court on May 1.  If convicted of the top charge, Richmond faces a potential sentence of 2⅓ to 7 years in prison.  The case is being handled by the Attorney General’s Office of Special Investigation, which is required under state law to investigate incidents where a police or peace officer may have caused a death, whether on duty or off duty.
