Attorneys seek dismissal in fatal I-71 crash case

COLUMBUS, Ohio (WCMH) -- A motion has been filed to dismiss the case against a semi-truck driver facing felony charges in a deadly Delaware County crash that killed a young family of three. In a court filing, Modou Ngom's attorney argues his constitutional right to a fair trial was violated. He cites a release from the Ohio Attorney General appointee, Andy Wilson, who was the Director of the State Department of Public Safety at the time. The statement from Wilson shared other criminal activity Ngom was allegedly involved in, including alleged immigration violations and fraud. The attorney argues that the press release brings attention to activity separate from the charges in the indictment, and "tainted the public perception" of Ngom. The attorney says Ngom has not been charged for the violations cited by Wilson. The state must respond to the motion to dismiss by May 22nd.
