Nearly a year since a fatal train collision in Reeves County, Texas, BOSS Heavy Haul, LLC, the company that owned the truck involved in the incident, has filed a countersuit against Union Pacific Railroad and the train crew, asserting that the railroad was aware of the risks at the crossing but failed to take sufficient action to prevent the tragedy. The collision occurred on December 18, 2024, when a Union Pacific train collided with a semi-truck at the Cedar Street grade crossing in downtown Pecos. Following the crash, BOSS has claimed that despite taking precautions such as employing a police escort and pilot vehicles to safeguard the oversized load being transported, the railroad's alleged safety lapses led to the disaster. The legal action also points out that this was the second accident at the same crossing, highlighting a pattern of safety oversights by Union Pacific. The complaint argues that the railroad's failure to adequately maintain the crossing and implement an effective warning system were contributing factors to the incident. Additionally, it criticizes Union Pacific's emergency response training and alleges that the train crew did not utilize available safety equipment during the collision. BOSS is pursuing monetary damages and aims to hold the railroad responsible not only for the Pecos crash but also for similar incidents nationwide.
