Resolution in suspected drunk driving death
A plea agreement has been reached in the case of Dakota Joseph Phillips, a Wichita Falls man indicted in September 2024 for intoxicated manslaughter and manslaughter in connection with a fatal crash in March 2024. Phillips, who was underage at the time, has agreed to plead guilty in exchange for a 10-year deferred sentence with community supervision. As part of the agreement, Phillips will spend 180 days in the Wichita County Jail and also face the condition of spending three nights in jail each year on the anniversary of the fatal crash. This agreement, filed in January 2026 and set to be heard on February 6, 2026, also requires Phillips to admit where he was drinking before the crash, impacting a pending civil lawsuit from the family of the victim, Edgar Alarcon. The lawsuit seeks damages exceeding $1 million, alleging significant losses caused by the negligence of Phillips and a local establishment.
