Outrage over DUI charge for accused drunk driver in fatal Las Vegas crash

In Las Vegas, a driver who allegedly failed a sobriety test and caused a fatal motorcycle accident was charged only with driving under the influence, not death, as per court records. The incident involved Carlos Roberto Hernandez, who was driving a pickup truck when he struck and killed 35-year-old Kyle Burrell on July 4. Reports from Nevada State Police Highway Patrol indicated that Burrell was hit while exiting the North Durango off-ramp on the 215 freeway. Despite evidence of Hernandez's intoxicated state, including red, bloodshot eyes and the presence of alcohol containers near his vehicle, he was only charged with a misdemeanor DUI. Burrell's attorney, Ofelia Markarian, criticized the decision, pointing out the serious consequences of a DUI-related fatality. Hernandez was released without bail after admitting to marijuana use at UMC Trauma, where Burrell succumbed to crash injuries. Markarian emphasized the need for stronger charges, considering the clear evidence at the scene. Court documents hinted that charges might be revised based on further investigation, potentially to a DUI resulting in death charge. Hernandez's attorney emphasized the ongoing nature of the investigation and advocated for a comprehensive review of all facts before making judgments.
