Legislator names bill after teen killed in school van crash - WTAJ
A lawmaker in Pennsylvania intends to propose a change to the Fair Share Act within the state. The bill, crafted by Representative Andrew Kuzma, is dubbed "Samantha's Law" in honor of Samantha Kalkbrenner, a fifteen-year-old student from Allegheny County who tragically lost her life in a collision involving a racing driver and a school van. Kuzma's aim is to ensure clarity within the law and enhance fairness for those seeking damages when not at fault. His proposal would incorporate the recent legal decision in Spencer vs. Johnson by the Pennsylvania Superior Court, which emphasizes joint and several liability for defendants in cases where the plaintiff, like Kalkbrenner in the school van incident, bears zero responsibility. Currently, the Fair Share Act does not specify how a financial award should be divided if the plaintiff holds no negligence.
