
Israeli court deems garbage truck driver's fall during camera cleaning as a car accident
A recent court ruling in Israel has recognized a garbage truck driver as a traffic accident victim after he injured his back while cleaning the vehicle’s rearview camera. The judge ruled in favor of the driver, rejecting the insurance company’s argument that the incident did not fall under Israel’s Motor Vehicle Accident Compensation Law. The driver, who was around 20 years old at the time, was finishing up his shift when he encountered a dirty rear camera that obstructed his view. After attempting to clean it while on the truck, he slipped and fell, causing the injury. Despite the insurance company's contention that the rear camera was not essential for the truck’s operation, Judge Yaakov Goldberg disagreed. He determined that the driver's action of cleaning the camera qualified as "roadside repair" under the law, which defines a traffic accident as any bodily injury resulting from the use of a motor vehicle for transportation purposes, including roadside maintenance work. The judge also emphasized that the insurer’s argument undermined road safety principles, particularly regarding larger vehicles. Concluding that all necessary conditions were met, the court recognized the driver as a traffic accident victim and awarded him 5,000 shekels ($1,300) in legal costs.
