The driver, identified as Jose Gutierrez, 19, was ticketed on October 3 for driving 52 mph in a 35-mph zone. The citation was later reduced to a violation for driving 40 mph in the same zone. Despite being scheduled to address the ticket in court on January 5, Gutierrez was involved in the fatal crash on Tuesday while speeding on Cheyenne Avenue. His passenger, Adilene Diran Rincon, 20, and another driver, Edward Garcia, 38, lost their lives in the tragic event. Records show that Gutierrez had a previous encounter with law enforcement in April, where he was arrested for an altercation with a woman and had made threatening remarks towards a police officer. His court appearance regarding the recent crash was pending, but due to his hospitalization, it was uncertain if he would be able to attend.
