Driver in fatal Portillo’s accident in Oswego won't be criminally charged
2-year-old fatally injured when vehicle crashes into Portillo's in Oswego, but no criminal charges will be pursued against the driver, according to Oswego police. The tragic incident occurred on July 30, injuring multiple individuals with ages ranging from two to individuals in their 60s. The 50-year-old driver mistakenly pressed the gas instead of the brake, causing the vehicle to collide with the restaurant where patrons were dining. Oswego police investigation revealed no criminal intent and determined the crash was a result of driver error, rather than impairment or distraction. Despite toxicology results showing a THC level below the legal threshold, no alcohol was present in the driver's system. Investigators also found that the crash did not meet the criteria for charges of reckless homicide or involuntary manslaughter. Although the family of the deceased toddler has filed a lawsuit seeking damages, Oswego Police Chief Jason Bastin expressed condolences and emphasized that it was a tragic accident where the driver's actions were not deemed criminal.
