China Court Rules on Workplace Sex Death

A 60-year-old security guard passed away while engaging in a sexual encounter with his girlfriend at his workplace, which was deemed an "industrial accident" by a Chinese court. The court determined that the security guard had the right to enjoy intimacy with his partner at work just as he had the right to basic needs like drinking water and using the restroom. The deceased, Mr. Zhang, had been the sole security guard at a small Beijing factory, working without breaks. He was found deceased in the security room of the facility where he was with his girlfriend. Following the incident, his son pursued compensation for his father's death but was initially denied by the authorities. Mr. Zhang's son argued that since his father was continuously on duty and could not leave his workplace, his death should be recognized as a workplace fatality. After a legal battle, the court ruled in favor of the family, entitling them to compensation and insurance benefits under the country's Industrial Injury Insurance Rule. Despite appeals by the social security office and the factory, the higher court upheld the decision that Mr. Zhang's death was indeed an occupational accident. The exact amount of compensation to be provided to the family was not specified in the released documents.
