Arbitrator mandates rehiring of Kansas City firefighter involved in deadly Westport collision

An arbitrator has determined that a Kansas City firefighter, Dominic Biscari, who was involved in a fatal crash in 2021, must be reinstated to his position with full benefits and back pay. The arbitrator's ruling also includes a three-day suspension without pay for Biscari and mandates that any termination references in his personnel file be removed. The crash occurred in December 2021, resulting in the deaths of two occupants of a Honda CR-V and a pedestrian. Following Biscari's guilty plea to three counts of involuntary manslaughter in February 2023, the city suspended him without pay and initiated termination proceedings. The firefighters union, IAFF Local 42, filed a grievance in March 2023, leading to the recent final arbitration ruling in Biscari's favor. The city had contested the decision in court, but the arbitrator reaffirmed it on August 18, 2025, directing the city to clear Biscari's personnel file of termination references. The union is now seeking confirmation of the ruling from the court, which would require Biscari's reinstatement.
